Delhi High Court rejects NOKIA’s plea which sought deposit of royalty by OPPO: Here’s what’s happened so far
NOKIA sought direction as to what’s happening about the deposit amount as royalty by OPPO. This comes in view of the alleged infringement of NOKIA’s patents in the context of its cellular technology. Recently, the Delhi High Court dismissed a plea by NOKIA over the same.
The court led by Justice Hari Shankar dismissed this plea. He also mentioned that the court cannot rely on the first FRAND agreement between the two brands, OPPO and NOKIA. There is no clear communication about the royalty rate via the official communication channels.
It was at a pre-trial stage. Justice Hari Shankar also added that he could not pass a judgment or order without any expert guidance in this matter. The bench ruled this on November 17, 2022. Later on, NOKIA challenged this order. A notice has now been issued to the brand OPPO pertaining to this matter.
This event took place on December 12, 2022. It was headed by Justice Manmohan and Justice Saurabh Banerjee. Their bench is responsible for the latest ruling on this issue.
The Chinese smartphone maker OPPO has often been accused of copyright infringement earlier in the near past. It faced problems in the Finnish market before this. What will happen next will be awaited.
