SP Group’s petition for review is accepted by the Supreme Court in Tata vs Mistry
The Supreme Court has accepted a review case filed by Shapoorji Pallonji Group, which challenges a top court ruling in favor of Tatas last year. The petition was approved by a 2:1 margin, and the hearing will take place on March 9th.
On February 15, a three-judge bench led by Chief Justice NV Ramana and including Justices AS Bopanna and V Ramasubramanian heard the review petition.
While deciding whether the petition should be accepted or not, V Ramasubramanian issued a note order, stating that he did not find any solid grounds to reconsider the judgment.
According to the judge, the arguments mentioned in the review petitions do not fit within the scope of a review, and hence the applications for an oral hearing should be dismissed.
Hearing the review petition was supported by Chief Justice Ramana and Justice Bopanna.
The Supreme Court upheld the Tata Sons board’s decision to remove Cyrus Mistry, the company’s then-chairman, from office and later the board in October 2016, and overturned the National Company Law Appellate Tribunal’s (NCLAT) earlier order restoring Mistry’s appointment as executive chairman of the Tata group.
Cyrus Mistry, the ousted chairman of Tata Sons, expressed disappointment on Tuesday with the Supreme Court’s decision in his case against the conglomerate, but insisted that his conscience was clear and that he had no doubt about the direction he took during his tenure regarding the generational change in leadership.
