An appeals court in the United States has upheld the ban on the Biden Covid-19 vaccine mandate
Supporters contend that they are necessary to halt the nearly two-year coronavirus outbreak, while opponents argue that they are unconstitutional and restrict individual liberty.
A US appeals court affirmed its decision to put on hold President Joe Biden’s order requiring COVID-19 immunizations for enterprises with 100 or more employees on Friday, dismissing his administration’s argument.
Despite the Biden administration’s claim that suspending implementation of the vaccine mandate could result in dozens or perhaps hundreds of deaths, a three-member panel of the 5th U.S. Circuit Court of Appeals in New Orleans upheld its decision. The mandate is “stunningly overbroad,” according to the decision.
Circuit Court Judge Kurt Engelhardt wrote for the pane, “The requirement is a one-size-fits-all bludgeon that makes hardly little attempt to accommodate for variances in workplaces (and people).”
In the United States, vaccine requirements are a hotly debated topic.

The judges in the Fifth Circuit appeared to agree with the opponents.
“Maintaining our constitutional system and the right of individuals to make profoundly personal judgments based on their own convictions – even, or perhaps especially, when those decisions frustrate government officials – serves the public interest,” Engelhardt said.
The Occupational Safety and Health Administration (OSHA) announced the rule, which requires enterprises with at least 100 employees to get their personnel vaccinated or face weekly tests and face mask restrictions.
Texas Attorney General Ken Paxton praised the decision as a triumph, while White House officials had no immediate comment.
Texas joined other states in filing legal challenges to the directive, as well as private employers and religious organisations.
“The 5th Circuit has suspended OSHA’s unconstitutional and illegal private-business vaccine mandate,” Paxton stated on Twitter, citing Texas’ “compelling argument.”
In September, Biden announced the mandate, telling Americans that “our patience is wearing thin” with individuals who refuse to be vaccinated.
