Major telecom companies including Airtel, Vodafone Idea asked for 15 Years to pay AGR due, SC reserves order

The Supreme Court on Monday saved its request on the timetable of installment of balanced gross income (AGR) related contribution by telecom organizations, including Vodafone Idea, Bharti Airtel, and Tata Teleservices. Both Vodafone Idea and Bharti Airtel have mentioned for a 15-year window to clear the contribution.

The summit court emphasized that there is “no space for self-appraisal” and telcos need to treat the AGR contribution evaluated by the telecom office as last.

The court additionally communicated question over Vodafone Idea’s ability to clear the levy, asking how it could “depend” on the organization for installment over a period given its money related position. The telco has looked for a long time to take care of the obligations versus 20 years sooner, tolerating contribution assessed by the DoT.

Mukul Rohatgi, speaking to Vodafone Idea, said the sum total of what incomes have been spent on liabilities, assessment and duty, with over ₹1 trillion of value got by advertisers being disintegrated.

“The whole total assets of the organization (Vodafone Idea) has been cleared out in the last 15 years…Of the absolute income of ₹6.27 trillion earned in the previous 10 years, ₹4.95 trillion has been spent on costs ,” Rohatgi told SC.

Abhishek Manu Singhvi, counsel for Bharti Airtel, said the DoT has wrongly determined its contribution which incorporates range use charges (SUC). Singhvi said AGR levy don’t include SUC yet just permit expenses.

Portions of Vodafone Idea wound up 1.8% at ₹9.04 on Monday, while that of Bharti Airtel rose 1.5% to ₹575.75 on the BSE. The benchmark Sensex settled at 37,418.99 focuses, up over 1% from the past close.

The zenith court on 18 June had asked telcos including Vodafone Idea, Bharti Airtel and Tata Teleservices to submit budget summaries and books of records of the most recent 10 years to evaluate their ability to clear the duty. The DoT had mentioned the court to permit a 20-year window for installment of levy, for which the pinnacle court had looked for a guide.

In its judgment on 24 October, the pinnacle court maintained the DoT’s more extensive meaning of AGR and requested telecom organizations to pay demands dependent on that definition, alongside enthusiasm on the chief sum and punishment. The DoT computes demands, for example, SUC and permit expenses dependent on AGR.

The court coordinated 15 telcos, including the ones which have closed tasks, to satisfy ₹1.47 trillion in AGR obligations inside a quarter of a year.

On Friday, Vodafone Idea paid the DoT another ₹1,000 crore as a component of its contribution identified with AGR, taking the ambushed telecom administrator’s absolute installments to ₹7,854 crore. The DoT’s gauge for Vodafone Idea was ₹58,254 crore, of which around ₹50,000 crore is as yet exceptional.

For Bharti Airtel, the DoT gauge remains at ₹43,780 crore, yet as indicated by the telco’s self evaluation, it owes ₹13,004 crore to the DoT. A week ago, three open division organizations – Gail (India), Power Grid Corp of India and Oil India – said the DoT has pulled back its interest sees for installment of AGR-related levy to the tune of ₹4 trillion. The SC had hammered the DoT for asking open division firms to clear AGR duty, considering it an “abuse” of its 24 October judgment.

As per DoT gauges, GAIL got request sees for 2001-02 to 2018-19 from DoT with AGR levy worth ₹1.83 trillion. For Power Grid and Oil India, the sums remained at ₹40,000 crore (FY07-FY19) and ₹48,489 crore (FY08-FY19), separately.
